I would like to let you know about new, timely and practical course that Pericles will be sponsoring starting Feb 12, 2011, “Transnational Bribery: FCPA Compliance.”    

 

Foreign Corrupt Practices Act (FCPA) prosecutions have exploded in the last 5 years.  In 2006, the U.S. Department of Justice brought two enforcement actions.  In 2009, it brought 26.  Cases have been brought against some of the biggest companies in the world.  In 2008, the German company Siemens agreed to pay more than $1.6 billion in fines and penalties to settle an FCPA case and in 2010 the British defense contractor BAE agreed to pay more than $450 million to settle FCPA charges.  Charges under the FCPA can be fatal for a company and therefore understanding the FCPA has become essential for every international business lawyer.  

 

Moreover, the new UK Anti-Bribery Act goes into effect soon and international companies can be subject not only to US liability but to extremely broad liability in the U.K.

 

Companies are hurrying to establish procedures and ensure that members of their staffs are knowledgeable on these issues to avoid potentially expensive liability.  Knowledge of FCPA rules is especially important to any company involved in international negotiations and contracting.

                                                                                                                         

This course, taught fully in English, will examine the key legal issues related to the FCPA, including what constitutes a bribe; who is considered a government official; corporate and successor liability; application of the federal sentencing guidelines; the elements of an effective compliance program; the “facilitating payments” and “promotional expenses” exceptions; the “business purpose” rule and the role of local law. 

The course will also examine the new U.K. Anti-bribery law.  

 

The course is taught by Thomas Firestone, Assistant U.S. Attorney and Resident Legal Adviser at the U.S. Embassy.   Tom has many years experience in Russia and has considerable hands on experience in the prosecution of organized crime and corruption cases.  He is a widely known writer and an excellent lecturer on FCPA compliance.  

 

The cost of the course is 22,000 rubles, not including the textbook, which can be purchased in limited copies from Pericles or purchased from web based booksellers, or  downloaded in Kindle and other bookreader editions.  There is a 3000 ruble discount for individuals who are not company sponsored, and for AIBEc students.  The course meets four Saturday mornings (February 12, 19, 26 and March 5) from 10:00-13:00.
